Not Affiliated Notice: NanoImg is not affiliated with Nano Banana or other model providers. These terms apply only to NanoImg services.

Acceptance of Terms

By creating an account or using our Services, you:

• Confirm you are at least 13 years old (or the minimum age required in your jurisdiction)
• Agree to comply with these Terms and our Privacy Policy
• Accept responsibility for your use of the Services

Description of Services

NanoImg provides AI-powered image editing tools including:

• Background removal and replacement
• Batch image processing
• Old photo restoration
• Image-to-image transformations
• Other AI-driven image enhancement features

User Accounts and Security

Account Registration

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your credentials
• Notify us immediately of any unauthorized use of your account
• One person or entity may maintain only one account

Account Security

• You are responsible for all activities under your account
• We may suspend or terminate accounts that violate these Terms

Acceptable Use Policy

You May

• Use our Services for lawful personal or commercial purposes
• Upload images you own or are authorized to edit
• Download and use your processed images
• Share processed images according to your ownership rights

You May NOT

• Upload illegal, harmful, or infringing content (including content depicting minors or third-party rights without authorization)
• Generate, request, upload, edit, transform, share, or distribute NSFW, adult, nude, sexually explicit, sexually suggestive, pornographic, or fetish content
• Use the Services to create or modify content involving minors in sexualized, exploitative, or otherwise abusive contexts
• Use the Services for face-swap, deepfake, impersonation, non-consensual intimate imagery, or deceptive identity manipulation
• Upload or process images that you do not own or lack permission to edit, including copyrighted, private, or biometric content used without authorization
• Create misleading, deceptive, or fraudulent content
• Attempt to reverse engineer, interfere with, or bypass security/usage limits
• Use automated tools to scrape or abuse our Services
• Violate any applicable laws or regulations
• Impersonate others or misrepresent your identity

Content Safety and Enforcement

• We use automated and manual safeguards, including prompt screening and risk reviews, to detect prohibited use
• We may block, refuse, pause, or terminate requests, accounts, subscriptions, or payouts-related access when we reasonably suspect policy violations, fraud, abuse, or legal risk
• We may retain limited audit logs, moderation decisions, billing records, and related technical metadata as needed to investigate misuse, enforce these Terms, and respond to payment, legal, or safety reviews
• Use of third-party AI providers does not reduce your responsibility for the content you upload, request, or generate through NanoImg

Intellectual Property & Your Content

Your Content

• You retain ownership of images you upload
• You grant us a limited, revocable license to process your images solely to provide the Services you request
• Unless you explicitly opt in, we do not use your content to train models (ours or third parties)
• You are responsible for ensuring you have rights to the content you upload

Our Services

• NanoImg’s software, algorithms, and Services are protected by intellectual property laws
• Our trademarks, logos, and branding may not be used without permission

Payment Terms and Billing

Subscription Plans

• Subscription fees are charged monthly or annually as selected
• Plans auto-renew unless cancelled; you can cancel at any time
• We may change pricing with 30 days’ notice to existing subscribers

Credits System

• One-time credit purchases are non-refundable except where required by law
• Credits expire according to the terms specified at purchase
• Unused credits are forfeited upon account termination

Payment Processing

• Payments are processed securely via Stripe or our payment processor (which may include Creem, depending on your region)
• You must provide accurate billing information; failed payments may result in suspension

Manage Billing & Cancellation

• You can manage payment methods, invoices, and cancel your subscription through Manage Billing in your account

Refunds

• Except as required by law or expressly stated for a specific offering, fees are non-refundable

Data Processing and Privacy

Image Processing

• Uploaded images are temporarily stored for processing (typically 24–48 hours) and then deleted
• We may use third-party AI services (e.g., model APIs) to perform transformations you request
• We implement security measures to protect your content during processing

Personal Data

• We collect and process personal data as described in our Privacy Policy

Service Availability and Performance

• We strive for high availability but do not guarantee uninterrupted service
• AI outputs may vary; processing times depend on image complexity and system load
• The Services are provided “as is” and “as available”

Limitation of Liability

To the maximum extent permitted by law:

• Our total liability will not exceed the amount you paid for Services in the 12 months prior to the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not responsible for third-party services or content

Indemnification

You agree to indemnify and hold harmless NanoImg from claims arising out of:

• Your use of the Services in violation of these Terms
• Content you upload or process
• Your violation of laws or third-party rights

Termination

By You

• You may terminate your account at any time via account settings (or through the Customer Portal)

By Us

• We may suspend or terminate if you violate these Terms, if required by law, or if we cease offering the Services

Effect of Termination

• Access ends immediately; data is deleted per our Privacy Policy
• Relevant provisions survive termination

Dispute Resolution

Governing Law
